Booking conditions

SPECIAL CONDITIONS

Smoking is prohibited on board except in designated exterior areas assigned by the crew.

Minors must always be accompanied or supervised by an adult and not under the responsibility of the crew.

Notwithstanding the above, the renting client acknowledges that the use of personal auxiliary boats or water toys on board is entirely at their own risk and agrees to indemnify, defend, and hold harmless the OWNER, their charterers, brokers, captains, and employees from and against any litigation, damages, expenses, or liabilities arising from the fulfillment of this Agreement or the use of auxiliary boats, among other claims, damages, expenses, or liabilities for fines, losses, or damages to any property or for death or injuries to any person or persons.

The lessor is not responsible for the water toys not included in the boat's inventory, and their proper use is the responsibility of the lessee and the owning company.

The parties agree that this contract exclusively concerns the rental of the boat defined in Clause 1, and the use of any nautical elements like seabobs or similar used by the lessee simultaneously with the contractual use of the referred boat will be at their sole responsibility. Any damages that may be caused to any persons, things, or the contracted boat itself during the validity of this agreement will be borne and paid by the lessee with their present and future assets. This clause expressly exonerates the chartering party from any related liabilities.

Alcohol is not allowed on board except for what is provided by the LESSOR.

All boats are equipped with a GPS tracking system.

Payments, including VAT, must be made in full before boarding to be entitled to departure.

It is customary and voluntary, but not mandatory, to tip the crew at the discretion of the lessee.

Illegal drugs and weapons are strictly prohibited on board.

 

USE OF THE BOAT

The Lessee agrees to use the boat properly and maintain it in good condition and to be responsible for the integrity of the items listed in the inventory, responding for any damage, breakage, theft, or loss.

The skipper will be responsible for the boat and navigating under appropriate safety measures, with the Lessee and other passengers committing to obey the skipper and crew's instructions at all times.

The lessee is responsible for the actions of all persons listed on the passenger list. The Lessee is obliged not to board a greater number of persons than authorized by law and the boat's license, using the boat for pleasure navigation only, explicitly prohibiting commerce, subleasing, assignment, professional fishing, transport, regattas, or any activity or use prohibited by law. Should this occur, the Lessee will be personally liable to the appropriate authorities, even in the case of involuntary fault. If any of these circumstances lead to the immobilization of the boat, the Lessor will be compensated with a fee equal to the current rental rate during the retention period of the boat. In case of confiscation, the Lessee must reimburse the boat's value within 10 days, with its price fixed at the time and by mutual agreement as the one listed in the rented boat's insurance policy.

 

PRICE, DEPOSIT, PAYMENTS, EXTENSION, AND FUEL

The duration of this rental contract will be expressly stipulated by the parties on the front of this document, understanding that one rental day equals EIGHT HOURS.

For any extension or variation of the schedule, consultation and agreement with the LESSOR are necessary. If the lessee voluntarily exceeds the eight-hour rental period, they must pay €100 per extra hour or fraction thereof. The boat must return to port before 9 p.m.

Any day of delay in returning the yacht to the agreed port will be billed at twice the daily rate, unless agreed with the company. The rental contract will not be considered terminated until the boat has been returned to the LESSOR's duly identified personnel, with the previous section prevailing in such cases. The boat must be returned by the LESSEE with full fuel tanks; otherwise, the LESSOR reserves the right to charge the LESSEE for the incurred costs plus a €50 refueling service fee.

 

The validity of this contract is subject to the condition that the Lessee pays 100% of the total rental amount.

 

The deposit amount will be used to cover all rental expenses not included in the rental rate (e.g., fuel consumption, provisioning of food and drink, docking fees outside the home port...). If the deposit is not used, the lessee must pay the rental expenses before disembarking. If it exceeds the incurred expenses, the balance will be returned to the lessee; if it does not cover the expenses, the lessee must pay the difference. The fuel amount will be calculated based on the engine hours used each day or the miles navigated, considering the boat's consumption. If a deposit has not been collected before boarding, the fuel must be paid before disembarking.

 

The contract will be perfected at the time of the boat's delivery, which the Lessor will do in good faith to coincide with the stipulated date. Otherwise, any excess money will be refunded or compensated economically.

 

If the lessee is partially or completely deprived of using the boat due to a breakdown during the rental period, they are not entitled to request a refund of the paid amounts unless it is attributable to the service provision, in which case the Lessee will be refunded for the days remaining until the contract is fulfilled.

 

If it is impossible to deliver the rented boat due to breakdowns or any other cause beyond the Lessor's control before the rental starts, a boat of equal or similar characteristics will be provided. If this is not possible, and at the lessee's choice, a lower category boat will be provided (with the corresponding proportional refund of the rental price) or the full rental price paid up to that point will be refunded.

 

The lessee agrees to pay the Lessor the agreed amount in the rental contract corresponding to duration, insurance, equipment, and complementary services, as well as applicable taxes and fees. The amount of damages suffered in whole or in part not covered by the exemptions contracted by the lessee. The amount corresponding to fines for any violation of current legislation and charges for payment delays and any judicial or extrajudicial expenses incurred by the Lessor as a result of the above.

 

INSURANCE

The boat subject to this contract is covered by an insurance policy, a copy of which is on board. The lessee acknowledges knowing its content and scope, obliging to take necessary measures to comply with the obligations contained therein, being solely responsible for the consequences of non-compliance. Neither the LESSOR, the skipper, nor the boat will be responsible for personal or material injuries caused by accidents related to diving, swimming, or activities such as water skiing, wakeboarding, small boats, jet skis, or any other nautical activity or sport.

 

DURATION

The rental period specified in the particular conditions of this contract may not be varied or altered without authorization.

 

RETURN

At the time of delivery, both parties will inspect the boat and check the inventory, declaring them satisfactory and in suitable condition for use at sea. The LESSEE agrees to return the boat in the same condition as at the beginning of the trip (conditions established according to the Check-List), although the final cleaning of the boat will be the LESSOR's responsibility. Negligence, improper use, mistreatment of the boat, and non-compliance with the law or this contract will be grounds for immediate termination, with the paid amounts remaining in favor of the LESSOR as compensation.

 

DEPOSIT:

The deposit amount will be held by the LESSOR and will serve as a guarantee for the correct fulfillment of the conditions of this contract and to cover malicious or negligent damage to the boat and its equipment and to cover possible losses or breakages of material, refueling, provisioning ordered by the LESSEE, port rights except for mooring expenses at the home port. The DEPOSIT will be provided by the LESSEE at the time of boarding and will be payable in CASH, VISA, or MASTERCARD. After the rental contract ends and the boat is returned, the balance will be refunded to the LESSEE after settling all extra charges and verifying the boat's and its equipment's good condition. The deposit will be refunded within 48 hours after the rental. In case of an accident, grounding, or any other circumstance directly attributable to negligence, malicious damage, or ignorance by the LESSEE, the LESSOR reserves the right not to refund the deposit to repair the damages caused or for the loss of commercial use of the boat. The minimum deposit amount is set at 1500 Euros, and it can reach up to 5000 Euros for some boats.

 

PERSONAL BELONGINGS OF PASSENGERS DURING THE CONTRACT

The lessor is not responsible for damages or losses that may occur during the rental period to passengers' personal belongings.

Cancel conditions

The lessee may unilaterally withdraw from the rental contract without obligation to indemnify and with the right to a refund of the paid amounts up to 60 days before the scheduled delivery date of the boat.

 

If the lessee decides within 60 days before the scheduled delivery date of the boat, the nautical broker will try to re-rent the boat, and if successful, the lessee will be refunded the previously paid amount. Otherwise, the nautical broker will retain 30% of the total rental price, including VAT.

 

For one-day rentals, if the captain considers that weather conditions may compromise navigation safety, the rental can be postponed to another date based on the boat's availability or a full refund of the charter fee as decided by the lessee.
